The Phosphotopia platform is operated by [FULL LEGAL NAME] ([FORM — inc. / reg.]), Québec enterprise number (NEQ) [NEQ], with its establishment located at [FULL BUSINESS ADDRESS], in Mont-Tremblant, Québec. Email: info@phosphotopia.com. Phone: (819) 425-8723.
Purpose
We offer the rental of entertainment equipment (inflatable games and related equipment) in Québec, bookable online, with delivery within our service areas or on-site pickup. These terms govern the use of the site and any distance rental contract.
Customer account
Booking requires an account. If you do not have one, an account is created automatically from your details when you book; after payment you then receive an email to activate it and choose your password. If an address already matches an existing account, logging in is required to complete the booking. You are responsible for the accuracy of your information and the confidentiality of your credentials. Two-factor authentication and passkeys are available to secure your account.
Booking and formation of the contract
The booking flow has you choose a product, dates, a delivery or pickup method, optional insurance, then enter your contact details and accept the liability waiver. The contract is formed when payment is confirmed. An unpaid reservation remains pending and may expire automatically, releasing the time slot.
Prices, taxes and fees
Prices are in Canadian dollars (CAD). GST (5%) and QST (9.975%) apply, as well as, where applicable, delivery fees based on zone and distance. The subtotal, taxes, fees and total are shown before payment. Pricing is always re-verified server-side before charging.
Payment
Payments are processed by Stripe. We never store your full card number: only the card type and last four digits are kept for display and receipts. Payment security (PCI-DSS) is handled by Stripe.
Security deposit
Some products require a security deposit, the amount of which is shown before payment. At booking, your card is pre-authorized (no immediate charge) and securely stored with Stripe. After the rental, we may charge all or part of the deposit, up to the pre-authorized amount, in the event of damage, loss, excessive soiling or late return. Otherwise, the pre-authorization is released. A charge may require bank authentication (3-D Secure); if so, we send you a secure link to authorize it.
Delivery and pickup
Delivery is available within our service areas; fees depend on the distance between our starting point and the delivery address, estimated automatically. You must ensure clear access and a suitable installation surface (dimensions, ground, clearance, power source where applicable). On-site pickup is available under the terms shown at booking.
Use of equipment and safety
You agree to use the equipment safely and in accordance with the instructions provided, to supervise it adequately throughout the rental, and to respect age limits, user counts and weather conditions (inflatable equipment must not be used in high winds or storms). You are responsible for the equipment during the rental, from receipt to return.
Liability
You are responsible for damage, loss or theft occurring during the rental period, within the limits set out above. To the extent permitted by law, our liability is limited to the amount paid for the rental concerned. Nothing in these terms is intended to exclude the rights granted to you by the Consumer Protection Act that cannot be waived. [TO BE REVIEWED BY YOUR LAWYER — exclusion and indemnification clauses.]
Cancellation
Cancellation and refund terms are set out in our Cancellation and Refund Policy, which forms an integral part of these terms.
Customer reviews
After a rental, you may leave a review (rating and comment). Reviews are moderated before publication; we may reject or remove inappropriate content.
Intellectual property
The site's content (brand, text, visuals, code) belongs to [LEGAL NAME] or its licensors and may not be reproduced without authorization.
Governing law and language
These terms are governed by the laws of Québec and the laws of Canada applicable therein; any dispute falls under the courts of the judicial district of [DISTRICT]. In accordance with the Charter of the French Language, the French version of these documents prevails.
Changes and contact
We may amend these terms; the version in force is the one published on the site. For any question: info@phosphotopia.com.
